A probate is a public court proceeding, governed by the laws of each state, in which your money and property are accounted for and administered. It involves additional expenses, delays, and administrative burdens to your already grieving family.  

Without preparing an estate plan, the state will control who receives your assets, how, and when, without regard to your desires or intentions. Even with a will in place, your estate may still go through probate.  


 

Ask yourself the following:

  • Do I want the state to dictate how and to whom my assets will be distributed?

  • Do I want information about my money and property to be publicly available?

  • Do I want my loved ones burdened with administrative tasks while grieving their loss?

  • Do I want it to take several months or years before my money and property are distributed to my loved ones?
